Si vous avez achet\u00e9 une propri\u00e9t\u00e9, vous disposez sans doute de recours par rapport aux vices cach\u00e9s qui la rendent inad\u00e9quate ou qui auraient fait en sorte que vous l\u2019auriez pay\u00e9e moins cher afin de faire effectuer les r\u00e9parations qui s\u2019imposaient. D\u00e8s que vous avez connaissance d\u2019un vice, vous devez obtenir un avis juridique imm\u00e9diatement pour \u00e9viter la prescription et ne pas compromettre vos droits.<\/p>\n<p>Le <em>Code civil du Qu\u00e9bec<\/em> (art. 1726) d\u00e9finit un vice cach\u00e9. En d&rsquo;autres termes, le d\u00e9faut doit \u00ab rendre le bien impropre \u00e0 l&rsquo;usage auquel il \u00e9tait destin\u00e9\u00a0\u00bb ou \u00ab\u00a0diminuer d&rsquo;autant son utilit\u00e9 que l&rsquo;acheteur n&rsquo;aurait pas achet\u00e9 ledit bien ou aurait pay\u00e9 moins s&rsquo;il l&rsquo;avait su\u00a0\u00bb. Deuxi\u00e8mement, par d\u00e9finition, le d\u00e9faut doit \u00eatre cach\u00e9. Si le d\u00e9faut est apparent pour un acheteur prudent et diligent sans recourir \u00e0 un expert, ou, si le vice cach\u00e9 est connu de l&rsquo;acheteur, la garantie l\u00e9gale contre les d\u00e9fauts cach\u00e9s ne s&rsquo;appliquera pas.<\/p>\n<p>S\u2019il y a un vice cach\u00e9 \u00e0 la propri\u00e9t\u00e9, l\u2019acheteur doit notifier ce d\u00e9faut par \u00e9crit au vendeur dans un d\u00e9lai raisonnable apr\u00e8s avoir d\u00e9couvert le d\u00e9faut. Cet avis permettra au vendeur d\u2019y rem\u00e9dier. Si, apr\u00e8s cette premi\u00e8re notification, le vendeur refuse de rem\u00e9dier au d\u00e9faut, l\u2019acheteur doit alors envoyer au vendeur une lettre de mise en demeure lui sp\u00e9cifiant le montant des dommages r\u00e9clam\u00e9s et lui donnant un d\u00e9lai raisonnable de paiement.
