Mais qu&rsquo;en est-il de l&rsquo;enfant et du parent demeurant au Qu\u00e9bec? De toute \u00e9vidence, la garde partag\u00e9e n&rsquo;est pas possible. Cette discussion passera bri\u00e8vement en revue les facteurs qu\u2019un tribunal consid\u00e9rera lorsque l\u2019un des parents souhaite se relocaliser avec un ou des enfant(s) et que l\u2019autre parent s\u2019y oppose.<\/p>\n<p>La <em>Cour d&rsquo;appel du Qu\u00e9bec<\/em> a statu\u00e9<sup>1<\/sup> que les cas de relocalisation doivent \u00eatre examin\u00e9s en fonction de l&rsquo;int\u00e9r\u00eat sup\u00e9rieur de l&rsquo;enfant et de la bonne foi du parent qui souhaite d\u00e9m\u00e9nager.<\/p>\n<p>Lors de l&rsquo;\u00e9valuation de l&rsquo;int\u00e9r\u00eat sup\u00e9rieur de l&rsquo;enfant, plusieurs crit\u00e8res doivent \u00eatre consid\u00e9r\u00e9s. Ces crit\u00e8res incluent la relation de garde existante et la relation entre l\u2019enfant et le parent gardien; l&rsquo;opportunit\u00e9 de maximiser le contact entre l&rsquo;enfant et ses deux parents; les points de vue de l&rsquo;enfant; l\u2019habilet\u00e9 du parent qui d\u00e9m\u00e9nage \u00e0 r\u00e9pondre aux besoins de l\u2019enfant, le cas \u00e9ch\u00e9ant; la raison du d\u00e9m\u00e9nagement; et les avantages versus la perturbation caus\u00e9e \u00e0 l&rsquo;enfant par le d\u00e9m\u00e9nagement.<\/p>\n<p>Lors de l\u2019\u00e9valuation de la bonne foi du parent, le tribunal doit \u00eatre convaincu que les raisons de relocalisation sont rationnelles et ne sont pas simplement un caprice ou un pr\u00e9texte afin de tenir l&rsquo;enfant \u00e0 l&rsquo;\u00e9cart du parent qui n&rsquo;a pas la garde. Le tribunal doit aussi \u00eatre certain que le parent qui a la garde prendra les mesures n\u00e9cessaires afin promouvoir les droits d&rsquo;acc\u00e8s du parent non gardien.<\/p>\n<p>Les causes de relocalisation sont parmi les affaires de garde d&rsquo;enfant les plus difficiles pour les juges.
