Question en litige\u00a0:<\/strong>\u00a0 Est-ce qu\u2019une accord\u00a0de s\u00e9paration peut \u00eatre mise de c\u00f4t\u00e9 suite apr\u00e8s le divorce.\u00a0D\u00e9cision compl\u00e8te<\/a>.<\/p>\n

Les faits\u00a0:<\/strong> Les parties ont \u00e9t\u00e9 mari\u00e9es 29 ans et ont eu 5 enfants. Les parties \u00e9taient chacune repr\u00e9sent\u00e9e par avocat lors de leur divorce et ont fait appel \u00e0 un m\u00e9diateur lors de leur n\u00e9gociation d’un accord de s\u00e9paration.\u00a0 Un an apr\u00e8s le divorce, l\u2019\u00e9pouse a demand\u00e9 l\u2019annulation de l\u2019accord invoquant que le mari a exploit\u00e9 l\u2019\u00e9tat mental instable de l\u2019\u00e9pouse en cachant d\u00e9lib\u00e9r\u00e9ment ou en sous-\u00e9valuant ses actifs lors des n\u00e9gociations.<\/p>\n

D\u00e9cision<\/strong>\u00a0: La Cour Supr\u00eame du Canada a statu\u00e9 que le d\u00e9faut du mari de faire une divulgation compl\u00e8te et honn\u00eate de l\u2019information, qu\u2019il ait su que les n\u00e9gociations \u00e9taient fond\u00e9es sur des renseignements financiers erron\u00e9s et qu\u2019il ait profit\u00e9 de la profonde instabilit\u00e9 mentale de son \u00e9pouse, \u00e9tat qu\u2019il connaissait, a entrainer la n\u00e9gociation d\u2019un paiement d\u2019\u00e9galisation inf\u00e9rieur de 649\u00a0680\u00a0$ \u00e0 ce que l\u2019\u00e9pouse \u00e9tait en droit de recevoir. Le tribunal a annul\u00e9 l’accord de s\u00e9paration et l’ex-mari a \u00e9t\u00e9 condamn\u00e9 \u00e0 indemniser l’\u00e9pouse dudit montant\u00a0afin d\u2019indemniser l\u2019\u00e9pouse pour la perte caus\u00e9e par l\u2019entente abusive.<\/p>\n","protected":false},"excerpt":{"rendered":"
