Standard Desk Inc., 2013 QCCA 1473 (CanLII)"},"content":{"rendered":"<p><strong>Question en litige: <\/strong>Caract\u00e8re raisonnable de l\u2019avis d\u2019indemnit\u00e9 compensatrice de pr\u00e9avis et des dommages-int\u00e9r\u00eats moraux\u00a0<a href=\"http:\/\/canlii.ca\/t\/g0c6v\">D\u00e9cision compl\u00e8te<\/a><\/p>\n<p><strong>Les faits<\/strong>: L\u2019employ\u00e9, avec 41 ans d\u2019exp\u00e9rience en tant que superviseur de contr\u00f4le de la qualit\u00e9 \u00e0 Laval, gagnait 38 620 $ par ann\u00e9e.\u00a0 L\u2019employeur a donn\u00e9 un pr\u00e9avis de 2.5 mois, cependant, tous les employ\u00e9s ont \u00e9t\u00e9 avis\u00e9s 5 mois auparavant que la compagnie fermerait incessamment.\u00a0 L\u2019employ\u00e9 s\u2019est fait offrir un poste similaire avec les m\u00eames conditions avec un affili\u00e9 de l\u2019employeur \u00e0 Granby.\u00a0 L\u2019employ\u00e9 a refus\u00e9 et r\u00e9clame une indemnit\u00e9 totale de 24 mois ainsi que les dommages moraux.<\/p>\n<p>En premi\u00e8re instance, le juge a consid\u00e9r\u00e9 que l\u2019employ\u00e9 aurait d\u00fb accepter l\u2019offre de l\u2019employeur \u00e0 Granby, cependant octroi \u00e0 l\u2019employ\u00e9 une indemnit\u00e9 additionnelle de 14 mois tenant lieu de pr\u00e9avis.\u00a0 Ainsi, une p\u00e9riode totale repr\u00e9sentant 16.5 mois.\u00a0 Le juge n\u2019a trouv\u00e9 aucune preuve de dommages moraux parce que l\u2019employeur a exerc\u00e9 son droit de mettre fin \u00e0 l\u2019emploi sans faute et non de fa\u00e7on abusive.<\/p>\n<p><strong>D\u00e9cision:<\/strong> La Cour d&rsquo;appel a conclu que la d\u00e9cision du juge quant \u00e0 l&rsquo;absence de dommages moraux \u00eatre correct. En outre, la Cour a jug\u00e9 que l&#8217;employ\u00e9 ne pouvait pas \u00eatre bl\u00e2m\u00e9 pour avoir refus\u00e9 d&rsquo;accepter l&rsquo;offre d&#8217;emploi. La Cour a jug\u00e9 que l&rsquo;indemnit\u00e9 accord\u00e9e, compte tenu de la position des employ\u00e9s, a d\u00e9pass\u00e9 ce qui \u00e9tait raisonnable.
